What is meant by Trust?
As per the Indian Trusts Act 1882, a Trust is an obligation tied to the ownership of property, resulting from a trustor’s confidence in and acceptance by the owner or declared by the owner for the benefit of another party. Public Trust, under the B.P.T. Act 1950, encompasses an express or constructive trust for charitable or religious purposes or both, including temples, maths, wakfs, churches, synagogues, and other places of worship. To establish a valid trust, the trustor must specify their intent to establish the trust, the purpose of the trust, the beneficiary, and the trust property with reasonable certainty.
What are the benefits of forming a Trust?
The formation of a trust provides several benefits, including the creation of a legal entity governed by the provisions of the B.P.T. Act 1950. The trust is supervised and controlled by the Deputy or Assistant Charity Commissioner of the region where it is registered. As a result, the trust is subject to proper regulation of its income and expenditure, including an annual audit by a competent authority. Are all societies Trusts?
Not all societies are trusts. However, as per the definition of Public Trust under section 2(13), a public trust includes a society formed for religious or charitable purposes or both and registered under the Societies Registration Act 1860. These societies are converted into public trusts under the B.P.T. Act of 1950 after conducting the necessary inquiry and following the procedures outlined in the B.P.T. Rules, 1951. Therefore, only societies registered under the Societies Registration Act 1860, and fulfilling the requirements of the B.P.T. Act 1950, can be considered trusts.
Can any person become a trustee of any Trust?
No, not every person can become a trustee of any trust. Each trust is administered by its own trust deed, rules, regulations, or scheme, and the constitution of each trust prescribes the qualifications for becoming a trustee. If a person meets the eligibility criteria outlined in the constitution, they can become a trustee of that particular trust. Additionally, the constitution also outlines the mode of appointment of trustees, so any person willing to become a trustee must be familiar with the trust’s constitution, eligibility criteria, and appointment process.
